The right of occupancy shall terminate upon the earlier of (1) date of death of the person(s) named in the application, or (2) the date of sale or transfer of the property to a non-family member. WHEREAS, the Sadsbury Township Zoning Ordinance Section 411 permits Echo Housing, the Sadsbury Township Board of Supervisors has reviewed the application and has agreed to support the Application. NOW THEREFORE, in consideration of the mutual promises contained herein and intending to be legally bound hereby, the parties agree as follows: 1. Sadsbury Township does hereby grant approval to Property Owners for placement of a detached temporary single family dwelling unit. 2. Said temporary detached single family dwelling unit will be placed in accordance with the sketch attached. 1 (b) The right of occupancy shall terminate upon the earlier of (1) date of death of the person(s) named in the Application, or (2) the date of sale or transfer of the property to a non-family. This Agreement shall be recorded at the Lancaster County Recorder of Deeds for the purposes of imposing a restriction on the land which limits the use of the temporary dwelling as specified herein. (c) The property owners agree to immediately notify Sadsbury Township when (1) the death of the person(s) named in the Application occurs, or (2) the date of sale or transfer of the property to another individual occurs. (d) The Property Owners agree to abide by all zoning regulations of the Sadsbury Township Zoning Ordinance. (e) This Agreement shall be recorded at the Lancaster County Recorder of Deeds for the purposes of imposing a restriction on the land which limits the use of the detached temporary single family dwelling unit as specified herein with the terms of this Agreement. This restriction shall run with the land and is binding upon the successors and assigns of Property Owners. Upon removal of the temporary single family dwelling unit, a termination statement will be recorded evidencing tennination of this restriction. WHEREAS, a violation of the terns of this Agreement shall be considered a violation in accordance of Article 4 of the Sadsbury Township Zoning Ordinance and therefore punishable in accordance with Article 7 of the Sadsbury Township Zoning Ordinance adopted December 6, 2011. IN WITNESS WHEREOF, the parties have hereunto set their hands and seals the day and year first written above.
